Legislature passes Law on People's Air Defence

Hanoi (VNA) – The 15th National Assembly (NA) adopted the Law on People's Air Defence with all 449 deputies present at the ongoing 8th session in Hanoi on November 27 morning voting in favour.

Earlier, when presenting a summary report on explanations and revisions to the draft law, Chairman of the NA Committee for National Defence and Security Le Tan Toi stated that the draft law had been revised and finalised with seven chapters and 47 articles.

Regarding the mission of people's air defence, there are differing opinions on regulations in Clause 1, Article 5. Some suggested expanding the management scope to above 5,000 metres to ensure defence security and order at localities.

The NA Standing Committee stated that the draft law's provision for the people's air defence force to manage and protect airspace below 5,000m is based on the tasks, weaponry, and equipment allocated to the force, as well as its combat capability and coordination with other forces in combat readiness, combat, and defence against aerial attacks.

Currently, the people's air defence force is equipped with weapons capable of ranges exceeding 5,000m and air defence reconnaissance equipment capable of observing and detecting targets at altitudes below 5,000m. Therefore, the force is fully capable of managing and protecting the airspace below 5,000m. Based on this, the NA Standing Committee proposed the NA keep the regulation on the management scope at altitudes below 5,000m.

Regarding regulations on the import, export, temporary import for re-export, and temporary export for re-import of unmanned aircraft and other flying vehicles in Article 27, some opinions suggested reconsidering the licensing regulations for exporting unmanned aircraft and other flying vehicles to establish more flexible export policies for this sector in the future.

During the process of revising and finalising the draft law, the NA Standing Committee removed the provision that the Ministry of Industry and Trade grants export licenses for unmanned aircraft and other flying vehicles.
