PhanXuan Dung, Chairman of the National Assembly Committee for Science, Technologyand Environment, proposed major draft law amendments to the committee. Theamendments pertain to State policies on transfer technology, technologyassessment in investment projects and solutions to encourage technologytransfer and develop technology markets.
Accordingto Dung, Article 34 of the draft law gives priority to those using machines andequipment that Vietnam manufactured through public purchase.
NAdeputies argue that the article conflicts with World Trade Organisationregulations, banning protection of domestic products and those of InvestmentLaw.
Theregulation is also said to discourage research, innovation and development ofdomestically-manufactured technology.
NAChairwoman Nguyen Thi Kim Ngan demanded a reconsideration of Article 34,wanting to assure that it is “in accordance with Vietnam’s integration contextand Competition Law”.
Stateassets given to scientific technology researchers must be presented tomanagement agencies after research is finished. These agencies must responsiblymanaging them as State assets, Ngan said.
Dungalso called it necessary to assess and control imported technology to put anend to obsolete technology that causes pollution and affects human health. Themove also aims to prevent impacts on Vietnam’s investment and business climate.
Ngansaid State agencies’ technology assessment responsibilities must be clarifiedin the law.
“Iftechnology that causes pollution is approved, which agencies must holdresponsible?,” she asked.
Thecommittee agreed that technology assessment is a complicated process,especially the assessment of technology transferred from overseas. Theassessment time of imported technology must be in accordance with theInvestment Law and requires longer time. However, it must reduce unnecessaryadministrative procedures that cause obstacles for enterprises.
Thedraft law also proposes the establishment of National Technology InnovationFund which supports small and medium-sized enterprises to transfer technologyand boost technology transfer serving agriculture, forestry and aquaticproducts in disadvantaged areas.
NAChairwoman Ngan rejected the fund, saying that it only expands the NationalTechnology Renovation Fund, which is stated in hi-technology law.
TheCommittee reached final conclusion that the draft law on technology transfermust be reviewed in accordance with Public Asset Management Law and avoidoverlaps with laws on State budget, tax, investment, science-technology toensure its feasibility.
Thelaw terminologies must also be reviewed to ensure the synchronisation withthose stated in Law on Science and Technology.-VNA
